1. SCOPE OF APPLICATION

1. These terms and conditions apply to contracts for the temporary rental of holiday apartments for accommodation and related services provided by Aneta Schilling.
2. Subletting or transferring use of the rented apartment for purposes other than accommodation requires prior written consent from Aneta Schilling.
3. The customer’s general terms and conditions only apply if this has been expressly agreed in writing in advance.

2. CONTRACT CONCLUSION, PARTIES, STATUTE OF LIMITATIONS

1. Aneta Schilling may confirm a booking in writing.
2. The contracting parties are Aneta Schilling and the customer. If a third party makes the booking on behalf of the customer, they are jointly liable with the customer.
3. All claims against Aneta Schilling are subject to a one-year limitation period beginning with the statutory limitation start. Claims for damages expire after five years. This reduction does not apply to claims based on intentional or grossly negligent conduct.

 3. SERVICES, PRICES, PAYMENT, SET-OFF

1. Aneta Schilling is obliged to provide the booked holiday apartment and the agreed services.
2. The customer is obliged to pay the agreed prices for the accommodation and any additional services used. This also applies to third-party services arranged by Aneta Schilling on the customer’s behalf. Prices include statutory VAT.
3. Reductions in number of guests, services, or length of stay requested after booking may result in price adjustments.
4. Invoices must be paid in advance and without deduction. In case of delay, a late fee of €25 may be charged.
5. A deposit or full prepayment of 100% may be required upon booking.
6. In justified cases (e.g., payment arrears), Aneta Schilling may refuse further services. 7. Offsetting is only permitted with undisputed or legally established claims.

4. CUSTOMER CANCELLATION / NO-SHOW

1. Cancellations must be confirmed in writing by Aneta Schilling. Otherwise, full payment is still required.
2. If a free cancellation deadline has been agreed, the customer can cancel in writing without charge until that date. After that, the right expires.
3. If the apartment is not used and not re-rented, Aneta Schilling may charge 100% of the agreed price.
4. Cancellation rights expire 14 days before the agreed arrival date.

5. CANCELLATION BY ANETA SCHILLING

1. If the customer was granted a free cancellation period, Aneta Schilling may also withdraw within that time (e.g., non-payment of deposit).
2. No compensation claims arise from justified cancellation by Aneta Schilling.

6. APARTMENT AVAILABILITY, HANDOVER, RETURN

1. No claim to a specific apartment unless expressly agreed in writing.
2. Apartments are available from 3:00 PM on arrival day. Early check-in is not guaranteed.
3. On departure day, the apartment must be vacated by 11:00 AM. For late departure, 50% of the nightly rate may be charged until 2:00 PM, and 100% thereafter.

7. LIABILITY OF ANETA SCHILLING

Aneta Schilling is liable under the contract. Liability for damages is excluded, except for damages caused by intent or gross negligence or that result in injury to life, body, or health. If disruptions occur, the customer must report them immediately. Aneta Schilling will seek remedy within reason.

8. CUSTOMER LIABILITY

1. Duty of Care: The customer must treat the apartment and furnishings with care. Damage must be compensated. Complaints must be reported immediately; otherwise, no claim for rent reduction applies.
2. House Rules: The customer must follow the house rules, which are available in the apartment.



9. FINAL PROVISIONS

1. Changes or additions must be in writing. Unilateral changes by the customer are invalid.
2. Place of performance and payment is Görlitz.
3. German law applies. The UN Convention on Contracts for the International Sale of Goods does not apply.
4. If individual provisions are invalid, the remaining terms remain valid. Legal regulations apply otherwise.
